In addition, when you use any of our services, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they are incorporated into this Agreement by this reference. We are trading as www.aquaticavenue.com, www.aquaticave.com, and/or www.aquaticavenue.sg. ACCESSING, BROWSING OR OTHERWISE USING THE SITE AND ITS SERVICES INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS IN THESE TERMS AND CONDITIONS , SO PLEASE READ THESE TERMS AND CONDITIONS  CAREFULLY BEFORE PROCEEDING.  References in these Terms and Conditions to "we", "us" and “Aquatic Avenue” are to Aquatic Avenue LLP (Registration/UEN No: T11LL0699C), registered office: 20 Maxwell Road #09-17 Maxwell House Singapore 069113

·         “Customer” & “You” means all people who purchase products through this website; and

·         “Product/Products” shall refer to products offered for sale by Aquatic Avenue LLP on this website.

The Customer consents to disclose all informatio­n provided to all staff, agents, representatives, service providers and contractors of Aquatic Avenue LLP, its service providers and contractors, including home delivery personnel and consents to Aquatic Avenue LLP’s use of such information provided.  We respect your privacy & will not share this data with any party for getting any indirect financial benefit but only for fulfilling our obligation to you as stated in the agreement & to improve our service for you.

You represent and warrant that you are at least 18 years old or visiting the Site under the supervision of a parent or guardian. You also warrant that all information that you are required to provide is at all times true, accurate, current and complete.

Subject to these Terms and Conditions, we hereby grant you a limited, revocable, non-transferable and non-exclusive license to access and use the Site by displaying it on your internet browser only for the purpose of shopping for personal items sold on the Site and not for any commercial use or use on behalf of any third party, except as explicitly permitted by us in advance. Any breach of these Terms and Conditions shall result in the immediate revocation of the license granted in this paragraph without notice to you.

Except as permitted in the paragraph above, you may not reproduce, distribute, display, sell, lease, transmit, create derivative works from, translate, modify, reverse-engineer, disassemble, decompile or otherwise exploit this Site or any portion of it unless expressly permitted by us in writing.

 

Online shopping

1.1        Every care has been taken to ensure that the photographic representation, description and specification of each Product is accurate. However, while the reproduction of images is a close representation, a slight variation in the actual goods may occur. We are therefore unable to guarantee that the product images you see are an accurate representation of the actual merchandise. Before you place an order you should read these Terms and Conditions carefully as they contain important information about your order.

 

1.2        By submitting an order to us through our website, you represent and warrant that the payment details provided on your order are valid and correct. By placing an order you confirm that you are the person referred to in the Billing details.

 

1.3        Visitors under the age of 18 should not register with this website or submit any information to us.

 

1.4        We accept payment by Paypal, Mastercard & Visa credit cards.  All transactions will be denominated in Singapore dollars (“$”). We will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us when placing an order.

 

Acceptance of your order

2.1        An email will be sent to you after you have placed an online order with us acknowledging the details of your order.  Should you not receive an acknowledgment within 3 working day, please contact our customer service team at aquaticavenuellp@gmail.com. For purposes of these Terms and Conditions, all references to time are to Singapore time, and “working day” means a day, excluding Saturdays, Sundays and Singapore public holidays, on which Aquatic Avenue LLP is open for business.

 

2.2        Acceptance of an order placed by you online and the completion of the contract between you Aquatic Avenue LLP will take place when your order is dispatched to the given address.

 

2.3        Aquatic Avenue LLP reserves the right in its sole discretion to reject orders of any Product that may have been presented wrongly or inaccurately on the website. The decision to honour any price discrepancy is solely at Aquatic Avenue LLP discretion and its decision shall be final.  

 

2.4        Aquatic Avenue LLP reserves the right to decline any order in its sole discretion In the event that an order has been declined by Aquatic Avenue LLP for any reason, the customer may contact our customer service team on AquaticAvenueLLP@gmail.com

 

2.5        All offers are subject to availability and while stocks last. In the event one or more Products in an order are unavailable, Aquatic Avenue LLP reserves the right to cancel the order or to proceed with the remaining order and adjust the final bill accordingly. No replacement or subsequent deliveries will be made for the unavailable Product(s).

 

Cancellation of Orders

3.1        As we endeavour to process the orders immediately, it is not possible to accept cancellation requests.

 

Refunds

4.1        If some of the Products that you ordered are not in stock with us at the moment or are damaged or missing during delivery, we will deliver the remaining part of your order for which the Products are in stock. For the products that are not in stock with us, are damaged or missing, we will process a refund to your credit card account. Once the processing of the refund request is done on our side, we will issue a request to the bank to process the refund. The duration that the bank will take to process the refund request & post the transaction in your credit card account statement is not controlled by us. You should contact the bank which issued you the credit card for more details. If Products are damaged or missing at the time of delivery, we request the customer to clearly indicate on the delivery order by circling the products that are damaged or missing in the list & stating the quantity that is missing. Please also mention whether the Product/s is/are damaged or the Product/s is/are missing beside every Product that you circle. At the end, you will also have to mention the total amount that is to be refunded at the bottom of the sheet & sign there. You will have to return this delivery order to the delivery personnel at the time of that delivery.

In the case of Customers who have made payment using Paypal, refunds will be in accordance with Paypal’s prevailing refund policy.  Further information on Paypal’s refund policy can be found on the Paypal website at www.paypal.com.

 

Pricing Policy

5.1        All prices shown on the Site are in Singapore dollars. Prices may change and offers may be withdrawn at any time.  Customers who order from outside Singapore will pay the same price as listed in the website.

 

5.2        Although we try to ensure all our prices displayed on the Site are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we may treat your order in respect of the incorrectly priced item as cancelled.

 

5.3        The price for Products on our online store may or may not be the same as our physical stores or associate stores. We do not accept any liability for any discrepancy between the prices in those physical stores & our online store.  

 

Product Availability

6.1        We feature products on our website that have been carefully selected for online shopping. Once an item is sold out it will be taken off the Site at the earliest opportunity and may not be available again. Prices of Products may change from time to time.  If items that you order are out of stock, subject to a delay or the price is higher than that shown on your order, we will not replace that product & will simply give you a refund based on our refund policy.

 

Delivery Information

Please note that the delivery information below applies only to orders placed online.

7.1        Delivery timing for local online purchases

Delivery would be made within 14 working days of your order. Our staff would contact you to confirm the time and location of delivery. If there is no confirmation, do contact Sales@AquaticAvenue.sg directly.

 

7.2        The timing above is the earliest delivery time; later delivery times can also be chosen when our customer service staff call you.

 

7.3        Delivery cost for all items between $1.00 to $100 is $10.00, and $5 for orders between $100.01 and above.

 

7.4        Delivery service is only available to valid addresses in mainland Singapore. Aquatic Avenue LLP reserves the right to decline any delivery to any address with restricted access or which is inaccessible.

 

7.5        Delivery must be acknowledged by the Customer or his/her authorized recipient during the delivery on the invoice presented by the delivery personnel. The Customer should ensure that an authorized recipient is present at the delivery address to receive the delivery, failing which Aquatic Avenue LLP reserves the right to charge a re-delivery fee of $10.00 for each subsequent trip.

 

7.6        The Customer should notify Aquatic Avenue LLP immediately, via email, of any change to delivery address and/or contact number. Aquatic Avenue LLP shall not be held liable if delivery is already initiated & the authorized recipient is unavailable for order reception; we will have to arrange for a re-delivery at another available time slot with a re-delivery fee of $10.00.

 

7.7        If the Customer has specifically instructed Aquatic Avenue LLP to leave his/her delivery outside the door of the address provided, such delivery shall be at the Customer's sole risk and Aquatic Avenue LLP shall not be liable for any missing Products thereafter.

 

7.8        Aquatic Avenue LLP shall reasonably endeavour to deliver orders to the valid and complete delivery address specified by the Customer within the time slot selected by the Customer but Aquatic Avenue LLP shall not be liable for any claims or damages costs due to delays in its delivery services.

 

7.9        All risk in the Products sold on this Site shall pass to the Customer upon delivery to the Customer’s delivery address and we will accept no liability thereafter for the delivery order in question.

 

The Site

8.1        We may change the Aquatic Avenue LLP website and correct or update information (including product information) on it or change these terms and conditions at any time without notice.

 

8.2        Except in relation to the description of Products and services available for order from the Site, we do not guarantee and are not responsible for the accuracy of any information provided on the Site.

 

8.3        You may access and use the Site for your personal, non-commercial use. Provided you retain all copyright and proprietary notices, you may:

           8.3.1     retrieve and display the content of the website on a screen; 

           8.3.2     print copies of the content for your own personal use; and

8.3.3     store the content in electronic form (except that you may not store it on any server or other storage device connected to a network).

 

8.4        You may not use this website or its contents:

           8.4.1     for commercial purposes;

8.4.2     for resale purposes including the systematic extraction and/or re-utilisation of any part of the contents of this website (eg. item listings, descriptions, prices);

           8.4.5     to interfere with the enjoyment or use of the Site  by any other person;

8.5        In addition you may not, in relation to this Site, use any:

           8.5.1 data mining, robots, or similar data gathering and extraction tools;

8.5.2     framing techniques to enclose the trade marks, logos and other proprietary images, text layouts and formats which we use on the website;

8.6        Using this Site does not give you permission to link to it or to use any of the trade marks, designs, get-up and/or logos contained within it.

 

8.7        We do not represent or warrant that the material contained in the website, any of the functions of the website and the server will operate without interruption or delay or will be error-free, free from defects, viruses or bugs or compatible with any other software or material. The website is provided "as is". Accessing the website is entirely at your own risk.

 

8.8        You must not transmit through or to our Site  any defamatory, threatening, obscene, distressing, harmful or pornographic material or material which may infringe upon the rights of others (including intellectual property rights, rights of confidentiality or rights of privacy) or which does not comply with all relevant laws.

 

8.9        This Site and its content including all text, graphics, logos, button icons, images, data compilations and software used in connection with this website, is our property or that of our suppliers and is protected copyright, trademarks, database rights and other intellectual property rights.

You acknowledge and agree that we will not be responsible for the availability of such Third Party Sites and will not be responsible or liable for any content or services available from such Third Party Sites. Liability and indemnity

9.1        We do not exclude or limit our liability or the liability of any other person for fraudulent misrepresentation or for death or personal injury resulting from our or their negligence. Except as set out above and in relation to our contractual obligations to supply goods and/or services following acceptance of orders placed on our website, neither we nor any of our agents, affiliates, directors, employees or other representatives will be liable in contract, tort, negligence or otherwise for any loss or damage whatsoever in any way connected with your use or misuse of the website or customer services. We shall not be liable for any indirect, or consequential loss of whatever nature, including damage to software or hardware, loss of data, damage for loss of business, loss of profits, or any other indirect or consequential loss arising out of or in connection with your use of the website or customer services (including without limitation, any such loss arising out of or in connection with any order placed on the website, whether or not accepted by us).

 

9.2        You agree to indemnify us and our agents and officers, directors and employees, immediately on demand, against all claims, liability, damages, costs and expenses, including legal fees, arising out of any breach of these Terms and Conditions by you.

 

9.3        We may terminate your use of the website immediately if we consider that you have breached these Terms and Conditions

10.1      When you place orders online, we collect certain personal and transactional information (eg name, address, email address, credit card details) from you. This is to fulfill our obligations to you under these Terms and Conditions & to communicate with you in the future. 

 

10.2      To fulfill our obligations to you under these Terms and Conditions we may communicate with you by email and by posting notices on the Site. You agree to receive communications from us electronically in this way and that electronic communications will satisfy any legal requirement for communications to be in writing.

 

Jurisdiction

11.0 The Site is controlled and operated in Singapore. These Terms and Conditions and all matters connected with any order you place on our website or over the telephone are governed by Singapore law and you agree to submit to the exclusive jurisdiction of the Singapore courts in relation to all matters connected with or arising out of the website or your use of customer services or any order you place on the website. 

 

General

12.1      If any of these Terms and Conditions are invalid or unenforceable, the remainder of these terms and conditions shall continue to have full force and effect.

 

12.2      We will not be responsible to you for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure arises from any cause beyond our reasonable control.

 

12.3      If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.

 

12.4      To the extent fully permitted by law, all warranties, descriptions, representations or advice given as to the fitness or suitability for any purpose, tolerance to any conditions, similarity to sample, merchantability or otherwise of the Products supplied, are expressly excluded.

 

12.5      No agent or representative of Aquatic Avenue LLP is authorized to make any warranties, representations or statements regarding the Products and Aquatic Avenue LLP shall not in any way be bound by any such unauthorized warranties, representations or statements.

 

12.6      No person other than the Customer and Aquatic Avenue LLP has any right to enforce these Terms and Conditions under The Contracts (Rights of Third Parties) Act, Chapter 53B.

 

Dispute Resolution

13.0        Any dispute arising out of or in connection with any contract arising from www.AquaticAvenue.com.sg, www.AquaticAvenue.sg and www.AquaticAve.com, including any question regarding it existence, validity or termination, shall be referred to and finally resolved by arbitration in Singapore in accordance with the Arbitration Rules of the Singapore International Arbitration Centre for the time being in force which rules are deemed to be incorporated by reference to this clause.
